- 1. YeeCloud reminds users to pay attention to the terms and conditions that exempt YeeCloud from liability and limit the rights of users in this Agreement. Users shall read them carefully and weigh the risks. Minors must read this Agreement accompanied by their legal guardians.
- 2.The validity, interpretation, and resolution of disputes of this Agreement shall be governed under the laws of the PRC. Any dispute arising between the users and YeeCloud shall be settled through friendly negotiation. If no agreement is reached, users agree to submit the dispute to the people's court that has jurisdiction where YeeCloud is located.
- 3.In the case that any term or condition in this Agreement is invalid or unenforceable, the others are still in effect and binding for both parties.
- 4.Services are provided by YeeCloud according to real-time situations and may be changed at any time. Users will receive notice of these changes.
- 1.Users may need to fill in or submit necessary information when registering or using the services, such as identity information as required by law, regulations, and regulatory documents (hereinafter referred to as "laws and regulations"). If the information submitted by the user is incomplete or does not comply with laws and regulations, the user may not use the services or may only use the services under restrictions.
- 2.Private information refers to information related to users' identity or privacy, such as users' real name, ID number, mobile number, mobile identification code, and IP address. Non-private information refers to basic record information reflected on the server side, such as users' operational status and service usage habits, other general information, and the aforementioned private information that users agree to disclose.
- 3.YeeCloud consistently respects users' privacy. Technological and other necessary measures will be taken to ensure the safety of users' privacy, preventing it from disclosure, damage, or loss. Should one or more of these cases occur or be likely to occur, YeeCloud will take remedial action in a timely manner.
- 4.YeeCloud agrees not to disclose the users' privacy to any third party without their consent unless:
- (1) YeeCloud must provide users' private information in accordance with laws and regulations, or to comply with authorities' instructions;
- (2) The private information is disclosed because the user tells their password to others or shares it with others, or due to other reasons not caused by YeeCloud;
- (3) An agreement has been reached between the users and YeeCloud, as well as its partners, regarding the use of users' privacy. YeeCloud may disclose users' private information to its partners;
- (4) The private information is disclosed due to hacker attacks, computer viruses, or other force majeure events.
- 5.Users consent to YeeCloud using their private information when:
- (1) YeeCloud sends users important notices, such as software updates and changes to the terms of this Agreement;
- (2) YeeCloud conducts an internal audit, data analysis, or research to improve its products, services, or communication with clients;
- (3) YeeCloud manages and checks users' information and takes measures according to this Agreement;
- (4) YeeCloud deals with other matters in accordance with laws and regulations.
- Apart from the above cases, YeeCloud will not use users' private information for any other purposes without prior consent.
- 1.YeeCloud has the right to examine and delete relevant content (including but not limited to user data) if it finds that a user has violated this Agreement or receives a report or complaint; YeeCloud will punish (including but not limited to warning, banning the ID, banning the equipment, and banning the function) the account according to the seriousness of the infraction, and will inform the user of the decision.
- 2.Users understand and agree that YeeCloud has the right to punish the behavior that violates relevant laws and regulations or this Agreement based on sound judgment. YeeCloud also maintains the right to take appropriate action and report relevant information to related departments in accordance with laws and regulations. Users shall bear all legal liabilities arising therefrom.
- 3.Users understand and agree that they shall compensate and not hold at fault YeeCloud, its cooperative corporations, and affiliated companies from all third-party claims, liability, or damages, including reasonable attorney's fees, in the case that they violate this Agreement.
- 4.Users understand and confirm that risks such as force majeure may interrupt services during usage. Force majeure refers to unforeseeable, insurmountable, and unavoidable objective events that have a significant impact on either or both parties, including but not limited to such natural disasters as floods, earthquakes, plagues, and storms, and such social events as wars, turmoil, and government actions. In the case of the aforementioned situations, YeeCloud will attempt to coordinate with relevant units in a timely manner to restore service. Consequences for loss of user or third party information arising therefrom, however, shall not be borne by YeeCloud and its cooperative corporation when allowed by law.
- 5.Like most Internet services, our services may be influenced by factors such as users, network service quality, and social environment, and be harassed by various security issues. For example, the user's information may be used by others, which may become a disturbance in real life; other software downloaded and installed by the users or other websites visited by the users may have Trojan viruses, which may threaten the safety of users' computer information and data, and may further influence the normal use of our services. Users shall strive to prevent information and user data from loss or harassment.
- 6.Users understand and acknowledge that our services may be interrupted or not be able to meet users' needs due to force majeure, computer viruses, hacker attacks, unstable systems, user location, shutdown, or other reasons regarding technology, the Internet, and the communication lines. Therefore, the consequences of loss of user or third-party information arising therefrom shall not be borne by YeeCloud.
- 7.Users understand and acknowledge that YeeCloud assumes no responsibility for any loss suffered by any user or third party caused by misleading, deceptive, threatening, scandalous, offensive, or illegal information, or by any anonymous or pseudonymous information and behavior accompanying such information that violates the rights of others from any other person when using the services.
- 8.Users understand and acknowledge that YeeCloud shall perform overhauls or maintenance on the platform or relevant equipment regularly or irregularly. YeeCloud assumes no responsibility for service interruptions arising therefrom within a reasonable timeframe, but shall give advance notice.
- 9.YeeCloud obtains the right to deal with illegal behavior or default content according to laws and regulations. This right, however, does not constitute a compulsory commitment to discover illegal behaviors or default content in any timely fashion or deal with it.
- 10.Users understand and confirm that YeeCloud assumes no responsibility for any quality defects in the following products or services or any loss arising therefrom:
- (1) Services provided by YeeCloud for free;
- (2) Any product or service presented by YeeCloud.
- 11.YeeCloud shall not be liable for any indirect, consequential, punitive, accidental, or specific damages under any circumstances, including any loss of profits caused when users use YeeCloud or its services (even when YeeCloud has already been informed of the possibility of any such loss). Although there may be provisions to the contrary in this Agreement, all responsibilities borne by YeeCloud to the users, no matter why and how, shall not exceed charges (if any) paid to YeeCloud by the users.
- 12.Users agree that YeeCloud has the right to change, interrupt, or terminate parts of or the entirety of its services (including charged services) due to the uniqueness of web services. YeeCloud shall notify the users before the change, interruption, or termination and provide the affected users with equivalent alternative services. YeeCloud shall issue a monetary refund after deductions according to the services the user used if the user has paid but is not willing to accept alternative services.
- 1.Any content produced by users when using the services or through the services does not reflect, represent, or be deemed as the opinion, attitude, or policy of YeeCloud. YeeCloud is not responsible for such content.
- 2.Users shall not use "YeeCloud" account or the services to:
- (1) Create a number of fake accounts through technological means;
- (2) Engage in any illegal or criminal activities;
- (3) Produce or release methods or tools related to the aforementioned behaviors, or operate or spread such methods or tools, regardless of whether it is for commercial purposes;
- (4) Engage in other behaviors that break the law, infringe upon others' lawful rights and interests, or interfere with the normal operations of YeeCloud, or behavior that has not been expressly authorized by YeeCloud.
- 3.Users shall be fully responsible for the authenticity, legitimacy, innocuousness, accuracy, and validity of messages conveyed through their "YeeCloud" account or services. Users shall bear the legal liabilities related to the messages they disseminate. Should there be any damage caused to YeeCloud or a third party due to these messages, users shall be liable for compensation according to the law.
- 4.The services provided by YeeCloud may contain advertisements. Users agree to display the advertisements provided by YeeCloud, third-party suppliers, and partners during usage. Users shall be responsible for transactions related to these advertisements. YeeCloud assumes no responsibility for any loss or damage suffered by the users due to transactions related to the advertisements unless it is explicitly stipulated by laws and regulations.
- 5.YeeCloud is not responsible for user failure regarding data deletion or storage when users access the services.
- 6.YeeCloud can decide the storage life of data according to actual situations, and may allocate the largest storage space on the server. Users may back up their data according to their own needs.
- 7.YeeCloud may permanently delete users' data if they stop using the services or the services are terminated. After the services are stopped or terminated, YeeCloud has no obligation to return any data to the users.
- 8.Content in this Article refer to any content produced, uploaded, copied, released, or spread by users when using the services, including but not limited to registration information such as icons, names, user information, certificated information or words, and other content generated when using the account or services.
- 9.Users shall not use their "YeeCloud" account or services to produce, upload, copy, release, or spread the following content that is prohibited by laws, regulations, and policies:
- (1) Content that opposes the basic principle of the Constitution;
- (2) Content that endangers national security, divulges state secrets, subverts state power, or undermines state unity;
- (3) Content that impairs state honor or interests;
- (4) Content that incites ethnic hatred or discrimination or undermines ethnic unity;
- (5) Content that breaks State religious policies or promotes cults or feudal superstitions;
- (6) Content that spreads rumors in order to disturb the social order and undermine social stability;
- (7) Content that spreads obscenity, eroticism, gambling, violence, murder, terror or subordination;
- (8) Content that insults or slanders others, or infringes upon others' lawful rights and interests;
- (9) Content that contains information prohibited by laws and regulations.
- 1.Unless otherwise stated, the copyrights, patent rights, and other intellectual property rights of the software on which YeeCloud provides services belong to YeeCloud.
- 2.The copyrights or trademark rights of the images, words, or other components related to the services, as well as logos, products and names of services (hereinafter jointly referred to as “YeeCloud Identities"), belong to YeeCloud. Users shall not display, use, or handle the YeeCloud Identities in any way without the prior written consent of YeeCloud; nor shall they indicate to others that users have the right to display, use, or handle YeeCloud Identities.
- 3.The aforementioned and other intellectual property rights legally owned by YeeCloud or relevant advertisers are protected by law. Users shall not use or create relevant derivative works in any way without the written consent of YeeCloud or relevant advertisers.
